Terms of Service

These Terms of Service ("Terms") govern your use of the QRiscover website, applications, QR portals, and related services (the "Service"), provided by MBVNC Ltd., a Colorado-based company ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.

Our Privacy Policy explains how we handle personal data, which service providers we use, and your choices. Accepting these Terms does not constitute consent to optional analytics or crash reporting.

1. The Service

QRiscover lets you scan and create QR codes, publish and manage dynamic QR portals, update destinations and content, and view portal scan statistics. Features and limits depend on your plan, platform, and the options shown in the Service. Some scanner and static-code features work without an account; online portals and account features require sign-in.

Dynamic portals depend on the continued availability of QRiscover and any linked content. A static QR code retains its encoded content, but an external destination may change or become unavailable. Test your codes before printing or distributing them.

2. Accounts and Eligibility

You must be at least 13 and meet any higher minimum age required by applicable law. If you are not old enough to enter a binding agreement, a parent or guardian must authorize your use where permitted by law. If acting for an organization, you must have authority to bind it.

Provide accurate account information and keep your email account, sign-in codes, links, and devices secure. Sign-in uses Firebase Authentication and email verification delivered through our email provider. Notify us promptly of suspected unauthorized access. You are responsible for your use of the account, subject to applicable law.

3. Free Features, Pro Subscriptions, and Purchases

Available offers: Free features and paid Pro features are described in the Service. The purchase screen and store checkout show the price, currency, billing period, applicable taxes, and any trial or introductory offer before you confirm a purchase. Trial availability, duration, and eligibility depend on the offer displayed to you; a free trial is not guaranteed.

Google Play and RevenueCat: Android in-app purchases are billed by Google Play. We use RevenueCat to validate purchases, associate subscription access with your QRiscover account, check subscription status, and restore eligible purchases. RevenueCat manages subscription access; it does not collect your card payment for these purchases. Google Play handles your payment method under its own terms. Purchase availability may differ by platform.

Renewals and trials: Auto-renewing subscriptions renew and are charged at the interval shown at checkout unless cancelled before renewal under the store's rules. If a trial converts to a paid subscription, its duration and subsequent price are shown before purchase. Cancel before the trial ends if you do not want the paid subscription.

Cancellation: Manage or cancel your Google Play subscription in Google Play under Payments & subscriptions. See Google Play subscription help. Cancellation normally stops future renewal, with access continuing until the end of the paid period, subject to the offer and store rules. Uninstalling the app, signing out, or deleting your QRiscover account does not cancel a store subscription.

Refunds and consumer rights: Refund requests are handled under Google Play's policies and applicable law. Nothing in these Terms excludes mandatory refund, withdrawal, warranty, or other consumer rights. Contact us if you need help identifying a purchase.

Restoring access: Use Restore purchases in the app with the relevant store account and QRiscover account. Restoration is subject to store and account eligibility and does not restore deleted portals or content. Billing failures, expiry, refunds, or revoked purchases may affect Pro access. Price changes follow applicable notice and consent requirements.

4. Your Content and Acceptable Use

You are responsible for content you upload, encode, publish, or link to, including obtaining necessary intellectual property rights and permissions to publish other people's information. Do not place confidential information in publicly shared QR codes or portals. Anyone who receives a public code or link may be able to view and redistribute its content.

• Do not publish illegal, fraudulent, defamatory, hateful, or infringing content.
• Do not distribute pornography, malware, phishing links, or deceptive destinations.
• Do not harass others, impersonate them, or disclose their private information without authorization.
• Do not bypass access controls, abuse sign-in or payment systems, or disrupt the Service.

You are responsible for any passwords or access restrictions you configure. We may review reports and restrict content or accounts that violate these Terms or applicable law. Portal owners are responsible for notices and permissions required for their own use of visitor information and for the external services they link to.

5. Service Providers and External Destinations

QRiscover relies on Google Cloud for hosting, databases, and uploaded files; Firebase Authentication for accounts; Resend for transactional email; and Cloudflare Turnstile for protection against automated abuse. Google Play and RevenueCat support Android subscriptions. We also use Google Analytics 4 on the website, Google Analytics for Firebase in mobile apps, and Firebase Crashlytics on Android, as explained in the Privacy Policy.

Google Fonts supplies website fonts. Portal statistics may use ipapi.co to estimate a visitor's region from an IP address when location information is unavailable from our hosting infrastructure. The Privacy Policy explains these data flows and analytics controls.

External websites, apps, and content opened through QR codes are operated by their respective providers and have their own terms and privacy policies. A link does not imply our endorsement. Service availability can be affected by networks, stores, maintenance, and provider outages. This does not limit any obligations or remedies that cannot be excluded under applicable law.

6. Intellectual Property

The Service, excluding your content and third-party materials, belongs to MBVNC Ltd. and its licensors. You retain ownership of your content and grant us a limited, non-exclusive, worldwide license to store, process, display, and deliver it as needed to provide the Service. This license does not transfer ownership of your content to us.

7. Suspension, Account Deletion, and Service Changes

You may stop using the Service and delete your account using the app or the instructions on our account deletion page. Deletion removes your account content from active systems after completion, and your dynamic portals will no longer be available. Keep any copies you need before deleting. Cancel an active Google Play subscription separately to prevent future charges.

We may restrict or suspend access where reasonably necessary to address a breach of these Terms, unlawful activity, security risks, or harm to others. We may change or discontinue features, subject to applicable notice requirements and rights relating to paid services. Data deletion and any required retention are described in the Privacy Policy.

8. Disclaimers and Liability

To the extent permitted by law, the Service is provided "as is" and "as available" without a guarantee of uninterrupted operation or the accuracy and safety of third-party content. To that extent, MBVNC Ltd. disclaims implied warranties and liability for indirect, incidental, special, consequential, or punitive damages, including lost profits or revenues.

Nothing in these Terms limits liability that cannot lawfully be limited, including for fraud, intentional misconduct, or other protected claims, or excludes statutory consumer guarantees.

9. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law provisions. If you are a consumer, this choice does not deprive you of mandatory protections or rights to bring claims that apply in your place of residence.

10. Changes to These Terms

We may update these Terms and will publish the revised version with a new date. For material changes affecting your rights or paid service, we will provide notice and obtain agreement where required by law. Changes do not replace any consent required for optional data processing.
